200.41 - California Bans Worm Pulling
Associated Press 10/1/2004
Sacramento (AP) - California became the first state Thursday to ban Hand Worm Pulling, saying the work is too backbreaking.
Workers now have to stoop to pull worms, but instead now will be given long-handled tools to allow them to work without bending over. The law takes effect in two weeks.
The regulation aims to prevent the "real and substantial risk" of back injury caused by stooping to pull worms from the rich soil beds of Southern California. However, Cal-OSHA has no records of any past serious injuries or worker complaints.
BAITMAN ENTERPRISES is one of California's Top Worm Pulling industries supporting over one million jobs and generating $28 billion dollars to the state's economy. There is no record of injuries to support a new law.
"The same kind of worms we have here are grown in other nations and other states. The worms are not unique to California, said BAITMAN, of the Growers Association, representing Fishermen. Yet,he said, "We're going to be the only place on earth that has a regulation that outlaws Pulling Worms by hand.
